1) Who we are

This booking platform (the “Platform”) is operated by DAO OSEAN YACHTING LIMITED, a company registered in Cyprus (Company No. HE469333, VAT 60156823Z, Nicosia 1097, Cyprus). Contact: info@osean.online — +44 20 3807 1004.

2) Scope

These Terms govern your use of the Platform and services provided through it (searching, quoting, reserving and paying for yacht charters and related extras). In most cases, your charter contract is concluded directly with the Operator (base/company). We act as a marketplace/intermediary and may collect payments on the Operator’s behalf as limited collection agent.

3) Eligibility & accounts

  • You must be 18+ and legally able to contract.
  • You’re responsible for the accuracy of details you provide and the security of your account.
  • Skippered/crewless charters may require licenses/certificates in the cruising area; you must comply with Operator rules.

4) Our role vs. Operators

  • We provide discovery, quoting, booking and payment tools.
  • Operators are solely responsible for the boat, seaworthiness, safety equipment, permits and delivery of the charter.
  • If an Operator policy shown at checkout conflicts with these Terms, that Operator policy prevails for that booking.

5) Booking & confirmation

  1. Pick dates/boat and submit a booking request.
  2. Prices include charter fee and mandatory extras disclosed at checkout; they usually exclude fuel, mooring away from base, fines, and security deposits unless stated otherwise.
  3. A booking is confirmed when you receive our confirmation and the required payment is successfully collected.
  4. Obvious pricing errors may be cancelled with a full refund or re-offer at the correct price.

6) Prices, currency & taxes

  • Unless stated otherwise, prices are in EUR (€).
  • Bank/card FX and cross-border fees are your responsibility.
  • We may use third-party payment processors; paying means you accept their terms.

7) Payments & schedule

(Unless the Operator states a different schedule at checkout/offer)

  • 50% deposit at booking to secure the vessel.
  • 50% balance due 30 days before embarkation.
  • Bookings ≤30 days before embarkation are typically 100% upfront.
  • Non-payment on time may lead to cancellation per the policy below.

Security deposit at base

Most charters require a refundable security deposit paid directly at check-in (credit card pre-auth or cash). Amount/method/return are set by the Operator/insurer. Deductions (if any) for damage, loss, late return, fuel or fines are handled by the Operator.

8) Extras & skipper

  • Optional extras (skipper, hostess, outboard, linens, early check-in, etc.) may be payable online or at base.
  • If a skipper is selected/required, you must provide a suitable berth/cabin and meals.

9) Cancellations, changes & refunds

Operator-specific policy shown at checkout always prevails. If none is shown, this Standard Policy applies:

Standard Cancellation Policy

  • > 90 days before embarkation: €150 admin fee
  • 90–60 days: 30% of charter price
  • 60–30 days: 50% of charter price
  • < 30 days: 100% of charter price
  • No-show / non-payment: treated as < 30 days

Refunds are sent to the original method and may exclude non-refundable processing/bank fees. Allow up to 14 business days after eligibility confirmation.

Changes

Changes are subject to Operator approval, availability, change fees and any fare differences. Lead-charterer substitutions require written approval.

Force majeure

If the charter cannot proceed due to government restrictions, natural disasters, war or similar force-majeure events, the Operator’s remedy (date change, credit, or refund as permitted by law) applies. EU 14-day withdrawal right usually does not apply to dated leisure services.

10) Check-in, use & return

  • Follow Operator check-in/out procedures and inventory checks.
  • Skipper must practice good seamanship, follow local law, respect weather limits and stay within permitted area.
  • Return on time, fueled as instructed, and in similar condition (fair wear & tear excepted).

11) Damage, loss & insurance

  • Operators typically carry hull & third-party liability insurance with a deductible equal to the security deposit.
  • You’re responsible for damage/loss caused by you/your crew and for costs outside coverage.
  • We recommend travel insurance and (if skippering) skipper liability insurance.

12) Conduct

No unlawful activity, fraud, platform interference or harmful content. We may suspend/terminate for violations.

13) Reviews & content

You grant us a worldwide, non-exclusive, royalty-free license to use/display your reviews for platform/marketing. We may remove content that violates these Terms.

14) Privacy

15) Intellectual property

All platform content, trademarks, and software are owned by us or our licensors. No copying/modification without permission.

16) Disclaimers

We don’t warrant uninterrupted or error-free operation. We do not operate vessels; Operators deliver the charter.

17) Limitation of liability

To the maximum extent permitted by law, our total liability relating to a booking or your platform use is limited to the platform/service fees you paid us for that booking. We are not liable for indirect, incidental, special, punitive or consequential damages. Nothing limits liability that cannot be limited by law. Statutory consumer rights remain unaffected.

18) Governing law & jurisdiction

Cyprus law governs. Courts of Nicosia, Cyprus have exclusive jurisdiction (subject to mandatory consumer rules). EU consumers may use the EU ODR platform.

19) Changes

We may update these Terms. The current version and date will always be shown here.
